• Infighting amongst organs of state rendering them less likely to meet constitutional mandate. Particular mention is made of the ongoing investigation into the affairs of acting National Police Commissioner, seemingly at behest of Independent Police Investigative Directorate (IPID) head, Robert McBride. News reports suggest that the squabbles are as a result of fallouts within the governing party’s purported factions.
  • The same fights are witnessed in the relationship between Treasury Head, Tom Moyane and the Minister of Finance, Pravin Gordhan - this tension is caused by Tom Moyane’s apparent refusal to make Treasury wholly accountable to the Finance Department. This is said to be as a result of attempts to unduly interfere with Treasury by some politicians within the governing party
  • The right to education is also under threat - the #FeesMustFall protests are in abeyance, however all TVET colleges across the country have been closed over allegations of their being largely incompetent and offering substandard qualifications.
  • Still on the right to education, textbooks and stationery for schools for the 2017 academic year in Limpopo have yet to be delivered, despite the highly publicised outcry and subsequent litigation in 2014.
  • Weakening of state institutions that are meant to hold public power accountable - namely the inauspicious start to the term of office of the new Public Protector. Also, the fact that high-ranking officials of the National Prosecuting Authority (Mrwebi and Jiba) have been struck off the roll of practicing advocates (a decision they are appealing), does not bode well for the nation’s constitutional democracy. The same weakening, and ‘capture’ of the SABC, as well as political interference within the broadcaster, means that the SABC is largely failing its constitutional mandate as a public broadcaster.
  • The erstwhile Public Protector released a report in late 2016 over allegations of ‘state capture’ in which she recommended the appointment of a commission of inquiry to look into allegations of state capture - which report is being challenged by the President, who is one of the implicated individuals in the report.
